1. Agreement to Terms

By booking services with Kunal Sharma Photography (“Photographer,” “we,” “us,” or “our”), you (“Client”) agree to be bound by these Terms and Conditions. These Terms constitute a legally binding agreement.

2. Services Offered

We provide professional real estate media services including:

• Real estate photography
• Videography and walkthrough videos
• FAA Part 107 compliant drone photography and videography
• Floor plans and visual measurement products (non-certified)

Services are provided at the discretion of the Photographer and subject to environmental, safety, and regulatory limitations.

3. Booking & Payment

Payment is due in full prior to delivery of any final media.

Invoices unpaid after 30 days are subject to late payment fees at the Photographer’s discretion. Failure to remit payment may result in collection activity and suspension of future service.

4. Cancellation, No-Show & Late Arrival Policy

• Cancellations within 24 hours of the scheduled shoot: $100 fee
• No-shows or late arrivals preventing completion of services: $100 fee
• Bad weather or hazardous conditions may be rescheduled at no charge, at the Photographer’s discretion
• If the property is not ready upon arrival, a re-shoot fee will apply

5. Property Readiness

Client is responsible for ensuring:

• Property is fully prepped prior to arrival
• Pets are secured
• Utilities are functional
• All staging is completed

The photographer does not provide staging services and is not responsible for site preparation.

6. Travel Fees

Shoots beyond 30 miles from Granada Hills, California may incur a travel surcharge.

7. Copyright & Licensing

All media remains the exclusive copyrighted property of Kunal Sharma Photography. Clients receive a limited, non-transferable license for marketing the specific property. Clients may not:

• Edit, modify, or alter images
• Sell, transfer, sublicense, or redistribute images
• Use images for unrelated listings or third-party marketing
• Claim authorship or ownership

Any reuse requires written permission for re-licensing.

8. Portfolio & Promotional Use

Only the Photographer may use media for marketing, portfolio, social, or promotional purposes. Clients may not publicly reuse images outside the original licensed purpose without written permission.

9. Drone Operations

Drone flights are subject to:

• FAA regulations
• Local airspace restrictions
• Weather and safety limitations

Photographer reserves the right to modify or cancel drone operations when unsafe or restricted.

10. Floor Plans & Measurement Disclaimer

All floor plans and visual measurements are approximate and non-certified.

They must not be relied upon for:

• Property valuation
• Legal descriptions
• Real estate investment decisions

Clients must independently verify all dimensions and information with qualified professionals.

11. Limitation of Liability

Photographer is not liable for delays, cancellations, or incomplete services caused by:

• Weather
• Power outages
• Equipment failure
• Government or FAA restrictions
• Client site conditions

Maximum liability is limited to the amount paid for the affected service..

12. Indemnification

Client agrees to indemnify and hold harmless Kunal Sharma Photography from any claims, damages, or liabilities arising from use of the delivered media:

This Agreement is governed by the laws of the State of California.
